Understand Our Terms And Conditions Before You Book

Please read our terms & conditions before booking with Fantastical Fruits, Balloons And Gifts in Doncaster and surrounding areas. We aim to provide clear, fair policies for every customer. Have a question? Get in touch for clarity or assistance.

Product Info
 

All fruit is freshly prepared on the day, and strawberries are newly dipped. 
 

We will endeavour to make your gift as shown on our website and Facebook page. Pots, baskets, ribbons, etc., can change depending on availability.
 

Please be aware that some products require the use of skewers or sticks to keep the fruit and sweets in place. Young children should be supervised at all times when consuming these products. We cannot be held responsible for any safety issues that may occur from the consumption of our products.
 

Please note that all our products may contain or have traces of nuts or nut oils. 
 

Fantastical Fruits & Gifts cannot be held responsible for any issues resulting from food allergies.
 

It is an offence to purchase or attempt to purchase alcoholic liquor if you are under the age of 18. If you order a bouquet containing alcohol, you and the customer must be over 18. Proof of Age is required. If no proof of age can be provided, the item will be taken away, and a 50% refund will be given.

 

When confirming a booking through any social media, Fantastical Fruits & Gifts will need to be provided with a mobile number. This will be used to send a summary of your order. Please check the details and advise if anything is incorrect. Once monies have been paid, this mobile number will also send a text receipt.

The Customer
 

The individual is booking Fantastical Fruits and Gifts for their event.

The following contract and its terms comprise an agreement between the provider and the customer, to hire Fantastical Fruits.

This written contract sets out the parties' full intentions and supersedes any previous written or oral agreements.


 

Payment

Deposits
 

A non-refundable deposit of £25 will be due to secure the date and booking. If the order is £25 or less, full payment is required.  

If you are booking as a package with the Photobooth, the deposit we require will be £150.
 

If we, the provider, are leaving equipment/stands with the customer, a refundable security deposit will be required in addition to the standard deposit. Once collected, this will be refunded to the customer, provided there is no theft or damage. 

 

The full payment is due 30 days before the event date.
 

Suppose the operator uses the equipment for a period in excess of the agreed service period. In that case, the customer will pay the provider additional rental charges, which are calculated pro rata.
 

Payment of all additional rental charges must be made by the customer before any additional service period commences.

 

 

 

Access, space & power requirements
 

The customer will arrange for an appropriate space for Fantastical Fruits and Gifts at the event venue.
 

The customer will provide a mains electricity supply comprising a single 13 amp socket located within the space designated by the customer for Fantastical Fruits and Gifts.

 

 

Date changes & cancellations
 

Any request to alter the agreed date of the rental of Fantastical Fruits must be made via email.
 

Any date change is subject to the availability of Fantastical Fruits on the alternative date and receipt of a new booking contract.
 

If the customer cancels an agreed booking, from the date of booking up until 31 days before the event date, the deposit will not be refunded.
 

If the customer cancels an agreed-upon booking within thirty days before the event date, the full amount will be due.

 

Loss or damage to provider equipment
 

The customer assumes complete responsibility for any loss of or damage to the provider's equipment (other than fair wear and tear) caused by misuse by the customer, their employees, or guests.
 

The customer shall be responsible for any loss or damage to the provider's equipment caused by theft, fire, flood or accidental damage.

 

Balloons
 

Once the balloons have left the provider's possession, either by collection or delivery, the provider no longer holds any responsibility and will not accept any liability for said balloons, including damage.


 

Indemnification

 

The customer agrees to and understands the following:
 

a) The customer will indemnify the provider against any and all liability related to the customer's event and use of the provider's equipment.

b) The customer will indemnify the provider against any and all liability associated with using any pictures taken at the customer's event by the photo booth or by its operatives, employees or affiliates.

 

The customer agrees to and understands the following:
 

The customer hereby releases, discharges and agrees to maintain Fantastical Fruits free from any liability arising from the taking of said picture or any subsequent processing or publication thereof, including, without limitation, any claims for libel or invasion of privacy. 


 

Miscellaneous terms
 

Suppose any provision of these terms shall be unlawful, void, or for any reason unenforceable under contract law. In that case, that provision, or portion thereof, shall be deemed separate from the rest of this contract and shall not affect the validity and enforceability of any remaining provisions, or portions thereof.
 

This is the entire agreement between the provider and the customer regarding the subject herein, and it shall not be modified except as agreed in writing by both parties.
 

In the unlikely event that it is not possible, other than for reasons beyond the provider's control, to provide the agreed service for at least 80% of the agreed service period, the provider shall make a refund to the customer calculated pro rata from the total charge made for the agreed service period.
 

If no service is received, the provider's maximum liability will be the return of all payments received from the customer. The provider is not responsible for any consequential damages or lost opportunities upon breach of this agreement. Fantastical Fruits and Gifts
